NOTICE OF FORECLOSURE SALE UNDER POWER
WHITE COUNTY, GEORGIA
Under and by virtue of the Power of Sale contained in a Security Deed given by James F. Allen and Linda G. Allen to The United States of America, acting through the Farmers Home Administration, United States Department of Agriculture, dated August 2, 1995, and recorded in Deed Book 434, Page 545, White County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of Sixty Thousand Two Hundred Eighty and 0/100 dollars ($60,280.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of White County, Georgia, within the legal hours of sale on January 2, 2019, the following described property:
All that tract or parcel of land lying and being in Land Lots 118 and 123 of the 2nd Land District of White County, Georgia, and being more particularly described as follows: TO LOCATE THE BEGINNING POINT, begin at a stone at the intersection of Land Lots 117, 118, 123, and 124, said District and County; thence South 02 degrees 29 minutes 29 seconds West 2,212.66 feet to an iron pin on the Easterly right-of-way of Dorsey Road a/k/a Old Hooper Road a/k/a County Road No. 33, hereinafter referred to as Dorsey Road, and TRUE POINT OF BEGINNING; thence North 85 degrees 00 minute 13 seconds East 516.54 feet to a point on the line of property now or formerly of George B. Dyer; thence South 22 degrees 16 minutes 06 seconds West 67 feet to a point; thence South 78 degrees 54 minutes 59 seconds West 509.83 feet to an iron pin on the Easterly right of way of Dorsey Road; thence along and with the Easterly right of way of Dorsey Road the following courses and distances: North 00 degree 51 Minutes 36 seconds East 11.62 feet to a point; and thence North 06 degrees 03 minutes 01 second East 104 feet to an iron pin and TRUE POINT OF BEGINNING. Said parcel of land contains 1 acre, more or less, as shown on Plat of Survey dated March 30, 1995, conducted by Albert M. Wynn, Jr., R.S., and Eddie Hood, White County, Georgia, Surveyor for Harold Fuller, recorded in Plat Book 35 Page 261, White County, Georgia, Deed Records.
SUBJECT TO all existing easements for public utilities.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given).
The entity having full authority to negotiate, amend or modify all terms of the loan (although not required by law to do so) is: USDA, Rural Development they can be contacted at (800) 349-5097 x 4500 for Loss Mitigation Dept, or by writing to 1400 Independence Ave, SW, Procurement Management Division, Washington, District of Columbia 20250, to discuss possible alternatives to avoid foreclosure.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
To the best knowledge and belief of the undersigned, the party in possession of the property is James F. Allen and Linda G. Allen or tenant(s); and said property is more commonly known as 697 Dorsey Road, Cleveland, GA 30528.
The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code (2) final confirmation and audit of the status of the loan with the holder of the security deed and (3) any right of redemption or other lien not extinguished by foreclosure.
