NOTICE OF SALE UNDER POWER
GEORGIA, WHITE COUNTY.
Shawn Blackwell has defaulted in the payment of unpaid unit expenses or condominium common expenses assessed by LORELEY CONDOMINIUM ASSOCIATION, INC., which unpaid assessments are now secured by a Lien for condominium assessments in favor of Loreley Condominium Association, Inc., dated February 22, 2024, recorded in Lien Book 64, page 589, White County, Georgia Lien Records (hereinafter referred to as “the Lien”) on the timeshare estate owned by Shawn Blackwell, or their heirs, successors, and assigns, said timeshare estate being Unit Week 52, Condominium Unit No. 03, Munich Building, located in Loreley Timeshare Condominium.
The undersigned has declared the full unpaid amount of the indebtedness secured by said Lien due and payable, and acting under the power of sale enumerated in O.C.G.A. § 44-3-206, for the purpose of paying said indebtedness, will on the first Tuesday in April, 2024, during the legal hours of sale at the steps of THE WHITE COUNTY COURTHOUSE, located at 259 S. Main Street, Cleveland, Georgia 30528 sell at public outcry to the highest bidder for cash, the following described property:
That certain timeshare estate, being Unit Week 52, Condominium Unit No. 03 in Munich Building of Loreley, A Timeshare Condominium, located in Land Lot 40 of the 3rd Land District of White County, Georgia, in the City of Helen, as set forth in that certain Declaration of Condominium for Loreley, A Timeshare Condominium, recorded in Deed Book 5T, Page 218, White County, Georgia, Deed Records, as now or hereafter amended (the “Declaration”) and as said Condominium Unit is shown and depicted on that certain Plat of Survey recorded in Condominium Plat Book 1, Page 5, White County, Georgia Plat Records, all as more fully described in the Declaration. The Unit Week herein described is succeeded by other Unit Weeks in consecutive and chronological order, revolving among the owners of the Unit Weeks in the aforesaid Condominium Unit as set forth in the Declaration, each such Unit Week being held separately and independently by the respective owner thereof; and continuing until 12:00 Noon on the first Friday in January in the year 2031; TOGETHER WITH a remainder over in fee simple, as a tenant in common with other owners of the Unit Weeks in the aforesaid Condominium Unit in accordance with the provisions of the Declaration.
This sale will be held subject to any outstanding ad valorem taxes (including taxes which are a lien but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Lien first set out above.
This sale, as authorized by O.C.G.A. § 44-3-206, shall divest the owner of all right, title, interest, and equity that such owner has in or to the timeshare estate and shall vest fee simple title to the timeshare estate in the purchaser or purchasers at said sale. The proceeds of said sale shall be applied first in accordance with the lien priorities set forth in paragraphs (1) through (4) of subsection (a) of O.C.G.A. § 44-3-109, after which any remaining proceeds shall be applied to the payment in full of such unpaid assessments and other charges and next to the payment of all expenses actually incurred by Loreley Condominium Association, Inc. in connection with said proceedings, including attorneys' fees, and any remaining proceeds shall be paid to the owner.
The person that has full authority to negotiate, amend, and modify all terms of the debt and lien with the debtor is Paul Standard, on behalf of Loreley Condominium Association, Inc., 387 Brucken Strasse, Helen, Georgia, 30545. Please understand that the secured creditor is not required by law to negotiate, amend or modify the terms of the lien.
The sale will be conducted subject to final confirmation and audit of the status of the debt with the holder of the lien.
The undersigned will execute a deed to the purchaser as authorized in the aforementioned deed to secure debt.
