Pursuant to a power of sale contained in a certain security deed executed by Danny Ray Evans, Sr. and Brenda Michelle Evans, hereinafter referred to as Grantor, to Mortgage Electronic Registration Systems, Inc. as nominee for Silverton Mortgage Specialists, Inc. recorded in Deed Book 1612, beginning at page 172, of the deed records of the Clerk of the Superior Court of the aforesaid state and county, and by virtue of a default under the terms of said security deed, and the related note, the undersigned attorney-in-fact for the aforesaid Grantor (which attorney-in-fact is the present holder of said security deed and note secured thereby) will sell at the usual place of conducting Sheriff's sales in said county within the legal hours of sale, to the highest bidder on the first Tuesday in October 2020, all property described in said security deed including but not limited to the following described property:
All that lot, tract and parcel of land, together with improvements thereon, lying situate and being in Land Lot 111, 2nd District, White County, Georgia and being Lot 4 of the Joe Cosner and Dan Mar Const, Property, containing 1.01 acres as shown by a plat entitled, "Survey for: Patricia Nuse Pratt", prepared by Thomas M. Patton, Georgia Registered Land Surveyor, dated April 13, 1989 and recorded in Plat Book 26, Page 86, White County, Georgia Plat Records, which plat is by reference made part hereof. AS shown by said plat, the property conveyed herein is more particularly described as follows:
To find the point of beginning, begin at an iron pin corner on the Southeastern right of way of County Road, No. 58 a/k/a Pless Road, a/k/a New Amys Ford Road, which iron pin is located 4,872.03 feet southwesterly of the intersection of the Southeastern right of way of County Road No. 58 with the right of way of Duncan Bridge Road; running thence South 47 degrees 50 minutes 04 seconds East 210.0 feet to an iron pin corner and the true point of BEGINNING; running thence from the point of beginning North 50 degrees 40 minutes 30 seconds East 212.99 feet to an iron pin corner; running thence South 47 degrees 24 minutes 00 seconds East 209.38 feet to an iron pin corner; thence South 50 degrees 30 minutes 00 seconds West 211.29 feet to an iron pin corner; running thence North 47 degrees 50 minutes 04 seconds West 210.26 feet to the beginning iron pin corner.
There is also conveyed herein the rights of ingress and egress over a private road easement as shown on the plat referred to above and the right to and from the easement to the gravel drive as shown on the plat, and is subject to the rights of others in and to the use of said private road.
This is a portion of the property conveyed by Warranty Deed from Glenn Fields to E. Joseph Cosner and Danmar Construction Company, dated June 15, 1987, recorded in Deed Book 83, Page 290, White County, Georgia deed records, and a Corrective Warranty Deed from Glenn Fields to B. Joseph Cosner and Andrew J. Daniel, d/b/a Danmar Construction, dated July 19, 1988 and recorded in Deed Book 149, Page 259, and a Quit Claim Deed from Danmar Outreach, Inc., d/b/a Danmar Construction Co. to Andrew J. Daniel dated September 16, 1988, recorded in Deed Book 160, Page 393, aforesaid records.
Said legal description being controlling, however, the Property is more commonly known as: 46 Timberlake Drive, Cleveland, GA 30528.
Said property will be sold on an "as-is" basis without any representation, warranty or recourse against the above-named or the undersigned. The sale will be subject to the following items which may affect the title: any outstanding ad valorem taxes (including taxes which are a lien but not yet due and payable); any matters which might be disclosed by an accurate survey and inspection of the property; any assessments, liens, encumbrances, zoning ordinances, restrictions, and all other matters of record superior to the said Security Deed. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed.
