Sale Under Power

Under and by virtue of a Power of Sale contained in that certain Deed to Secure Debt from Melody A. Thomas to Tina Everett, filed for record June 22, 2022 and recorded in Deed Book 1898, Page 393, White County, Georgia Records, given to secure a Note of even date in the original principal amount of Thirty Thousand Seven Hundred Seventy Five and 17/100 dollars ($30,775.17), with interest as provided thereon on the unpaid balance until paid, there will be sold by the undersigned at public outcry to the highest and best bidder for cash at the usual place for conducting Sheriff's sales in White County, Georgia, within the legal hours of sale on the first Tuesday in April, 2024, the following described property:

All that tract or parcel of land lying and being in Land Lot 42 of the 2nd Land District of White County, Georgia, designated as Lot 11 of the Oak Hill Estates Subdivision, containing 0.52 acres, more or less, as shown on a plat of survey prepared for Ricky A. Pruitt by Eddit hood, C.S., under date of January 18, 1994, a copy of said plat being of record in the Office of the Clerk of Superior Court of White County, Georgia, in Plat Book 34, Page 3, to which said plat and the record thereof reference is hereby made for a more complete description.

Together with a non-exclusive easement for ingress and egress via the court of existing subdivision roads shown on the plat referred to above.

Commonly known as: 50 Garrison Drive, Cleveland GA 30528

The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees.
The property will be sold subject to all unpaid ad valorem taxes, utility bills, assessments, restrictions, protective covenants, easements and any liens superior to the Deed to Secure Debt first set out above.
The individual or entity that has full authority to negotiate, amend and modify all terms of the mortgage with the debtor, although not required by law to do so, is Courtney S. Casper, 32 S. Public Square, Jefferson, Georgia 30549.
To the best knowledge and belief of the undersigned, Melody A. Thomas or tenant is/are in possession of said property.
The sale will be conducted subject to (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Deed to Secure Debt.
